These Terms govern your access to this website and your download and use of Tenet, qbditrace, their documentation, updates, and release packages. Please read them before using the Products.

Acceptance and scope

By accessing the website or downloading, installing, or using a Product, you agree to these Terms. If you do not agree, do not use the website or the Products.

The current Terms govern website access. A software release remains governed by the Terms made available with, or identified for, that release when you downloaded that version. Later website changes do not retroactively alter that software license.

02

Definitions

“Products” means the Tenet desktop application, qbditrace recorder, this website, documentation, updates, and official release packages. “Trace Data” means execution data captured by you. “Analysis Results” means reports, scripts, annotations, graphs, and conclusions you create from your analysis.

“Tenet Developer” means the individual publisher who provides the Products under these Terms.

03

Software license

Subject to these Terms, Tenet Developer grants you a limited, non-exclusive, non-transferable license to install and use the software personally or within your organization. The software is licensed, not sold; all rights not expressly granted are reserved.

  • Use for learning, research, debugging, interoperability, performance work, and authorized security assessment.
  • Internal use by businesses, institutions, and their personnel, including analysis supporting commercial products.
  • Rights that applicable law does not permit these Terms to restrict remain unaffected.
04

Research, modification, and results

You may inspect, reverse engineer, disassemble, and modify a copy you lawfully obtained for your own or your organization’s internal use, provided that you comply with applicable law and authorization boundaries.

  • You retain ownership of your Trace Data and Analysis Results.
  • You may publish or commercially use your own scripts, reports, research conclusions, and other Analysis Results.
  • Analysis Results must not include or distribute the Products, modified Product binaries, or protected Product materials unless separately authorized.
05

Distribution and commercial restrictions

Unless Tenet Developer gives prior written permission, you must not:

  • Redistribute, sublicense, sell, rent, lend, or otherwise provide the Products or modified copies to another party.
  • Host the Products as a service for third parties or offer a paid analysis service built primarily around the Products.
  • Present a modified build as official, remove rights notices, or use Tenet names or marks in a misleading way.
Internal research, development, debugging, and security assessment by an organization do not become a prohibited third-party service merely because they support commercial activity.
06

Responsible use

Use the Products only on software, systems, devices, accounts, and data that you own or are expressly authorized to inspect. The capabilities of the Products do not grant authorization to examine any third-party target.

  • Do not gain unauthorized access, attack systems, or exceed the scope of an authorization.
  • Do not steal credentials, cryptographic material, personal information, confidential information, or trade secrets.
  • Do not develop, deploy, or distribute malware, unlawfully bypass safeguards, disrupt services, or abuse website and download infrastructure.
  • Do not infringe intellectual property, privacy, data protection, or other rights of any person.
07

Trace Data and privacy

Tenet is designed to analyze Trace Data locally. The website does not ask you to upload Trace Data and does not inspect it. You are responsible for ensuring that capture, storage, analysis, and disclosure of your data are lawful.

Website analytics, infrastructure logs, and download records are handled as described in the Privacy Policy.

08

Downloads, updates, and third parties

Use official download locations and verify published SHA-256 checksums where available. Tenet Developer may change, suspend, or discontinue a Product, feature, release, or download at any time and does not promise that old releases will remain available.

Third-party components and platforms remain subject to their own terms. References to Apple, Cloudflare, or other providers do not imply their sponsorship, endorsement, or responsibility for the Products.

09

Technical risk and warranties

Dynamic instrumentation and trace analysis can crash a process, reduce performance, change timing, consume storage, expose sensitive data, or produce incomplete or incorrect results. Back up important data and independently verify material findings.

To the maximum extent permitted by law, the Products are provided “as is” and “as available,” without express or implied warranties of accuracy, availability, merchantability, fitness for a particular purpose, non-infringement, or error-free operation.

10

Limitation of liability

To the maximum extent permitted by law, Tenet Developer is not liable for indirect, incidental, special, punitive, or consequential loss, including loss of data, profit, revenue, opportunity, goodwill, or business continuity.

The aggregate liability arising from the Products or these Terms will not exceed the amount you actually paid for the Products during the 12 months before the claim. If you paid nothing, the aggregate limit is RMB 100.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability that applicable law imposes for intentional misconduct or gross negligence.

11

Suspension and termination

Your software license terminates if you materially breach these Terms. Tenet Developer may restrict access to website or download infrastructure to address unlawful conduct, security threats, abuse, or material violations. On termination, stop using and delete the software and modified copies in your possession.

Termination does not transfer or extinguish ownership of Trace Data or Analysis Results you lawfully created before termination, and provisions intended by their nature to survive will continue to apply.

12

Compliance and export controls

You are responsible for complying with applicable laws, including cybersecurity, data protection, intellectual property, export control, sanctions, and embargo rules. Do not provide or use the Products where doing so is prohibited by law.

13

Changes to these Terms

Tenet Developer may update these Terms and will publish the effective and last-updated dates on this page. Material changes will be highlighted on the website when reasonably practicable.

Updated Terms govern later website use and newly downloaded releases. A release you already downloaded remains subject to the Terms applicable when it was downloaded, except where an immediate change is required by law or is necessary to address unlawful use or a material security risk.

14

Governing law and disputes

These Terms are governed by the laws of the People’s Republic of China. The parties should first attempt to resolve a dispute through good-faith consultation. If consultation fails, either party may bring the dispute before a competent people’s court at the location of Tenet Developer. Mandatory rights that cannot lawfully be waived remain unaffected.

15

Contact and general provisions

For terms questions, permission requests, infringement notices, or security reports, contact Tenet Developer at legal@tenet.dev. This address is provisional and must be confirmed as operational before public release.

If any provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. These Terms and any release-specific notice form the entire agreement concerning their subject matter.
